ORDER
This writ petition has been filed for a direction to the 1 st respondent to consider the representation of the petitioner dated 14.12.2018, with regard to the issuance of another new patta to some other persons for the same land in which petitioner has already been issued patta in the proceedings Na.Ka.No.281/98, dated 03.07.2002, issued by the 2nd respondent and is residing in S.No.283/1 of an extent of 3 cents (Plot No.70) in Veerakkal Village, Mettur Taluk, Salem District and restoring of patta to her and in the meanwhile desist from evicting the petitioner from the said house site without due process of law. 2.The petitioner was assigned patta to an extent of 3 cents of land in plot No.70 in S.No.283/1, in Veerakkal Village, Mettur Taluk, Salem District. Thereafter, petitioner erected a thatched house and residing there for the past
3/6 several years. That being so, the concerned authorities without any notice to the petitioner, issued patta in favour of one Manikandan. Therefore, the petitioner had submitted a representation to cancel the patta issued in favour of the 4 th respondent.
3.A perusal of the counter filed by the 2 nd respondent and also the submissions made by Mr.T.Arun Kumar, learned Additional Government pleader for R2 reveals that as per the order of the District Adi Dravidar Welfare Officer, 36 beneficiaries were found eligible and were issued patta. The petitioner is one among the beneficiaries. Since they all are not the residents of that area, the 2 nd respondent cancelled the patta issued in favour of the 36 beneficiaries. However, the patta issued in favour of the petitioner was not cancelled.
4.That apart, the 4 th respondent was allotted with house plot No.67 and it is no way connected with the plot allotted in favour of the petitioner since the plot allotted to the petitioner is plot No.70. Therefore, the representation
4/6 submitted by the petitioner to cancel the patta issued in favour of the 4 th respondent does not arise.
5.Therefore, this Court is of the view that this writ petition is devoid of merits and it is liable to be dismissed. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is also closed.
