Respondent Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Certiorarified Mandamus calling for the records relating to the impugned notice of the 2nd respondent in Na.Ka.No.1915/2023/F1 dated 19.02.2024 and quash the same and direct the respondent Municipality not to proceed for evicting the petitioner from the premises which is situated at Ward No.C, Block No.6, Town Block No.9 (Old Block No.50/9), Mettur Municipality, Salem District to the extent of 2 cents.

ORDER

(Made by the Hon'ble Chief Justice) We have heard Mr.M.Senthilkumar, learned counsel for the petitioner and Mr.L.P.Maurya, learned counsel for the respondent.

2. On the last date, we asked learned counsel for the petitioner about the construction permission. He could not point out the same. At the request of learned counsel for the petitioner, the matter was adjourned to today. Today also, learned counsel for the petitioner has not produced the construction permission.

3. There would be no impediment for the respondent to proceed ahead with the notice issued to the petitioner.
