ORDER

Seeking a direction to the second respondent police to transfer the investigation in Crime No.260 of 2015 pending on his file to any other independent investigation agency, the petitioner has come up with this petition.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent police.

3.It is represented that Mr.Subramanian, former Inspector of Police, Edapadi Police Station has been arrayed as 12th accused in the FIR. Under such circumstances, this Court directs the Superintendent of Police, Salem District, Salem to transfer the investigation from the file of the Inspector of Police, Edapadi Police Station to the file of the Deputy Superintendent of Police, Edappadi Sub Division, Sangagiri to investigate the case in Crime No.260 of 2015.

4.The Deputy Superintendent of Police, Edappadi Sub Division, Sangagiri is directed to conduct enquiry expeditiously in https://hcservices.ecourts.gov.in/hcservices/

Crime No.260 of 2015 and take action in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)].

5.This Criminal Original Petition is closed with the above direction.
