O R D E R

This Writ Petition has been filed challenging the impugned proceedings granting patta in favour of the 8th respondent. 2.Admittedly, the petitioner, aggrieved by the issuance of patta for the property morefully disclosed in the prayer to this Writ Petition in favour of the 8th respondent, had given a representation to the official respondents seeking for cancellation of patta standing in the name of the 8th respondent. As seen from

the documents filed by the petitioner along with this Writ Petition, a separate representation has not been given by the petitioner to the competent authority, namely the 5th respondent, seeking for cancellation of the patta standing in the name of the 8th respondent. Necessarily, the petitioner will have to give a separate representation to the 5th respondent seeking for a cancellation of the 8th respondent's patta.

3.Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 5 & 7 and M/s.B.Tamilnidhi, learned Government Advocate, accepts notice on behalf of the 6th respondent. Since no adverse orders are passed as against the respondents 8 to 11, notice to the respondents 8 to 11 is dispensed with by this Court.

4.No prejudice would be caused to the respondents if a direction is issued to the competent authority, namely the 5th respondent, to consider the petitioner's representation seeking for cancellation of patta standing in the name of the 8th respondent, on merits and in accordance with law, after hearing the objections of the 8th - 11th respondents and any other third party, whom the 5th respondent deem fit to enquire.

5.The petitioner has filed supporting documents along with this Writ Petition in support of his contention that the patta issued in favour of the 8th

respondent is arbitrary and illegal. This Court is not expressing any opinion on the merits of the same. It is for the 5th respondent to consider the same on merits and in accordance with law.

6.For the foregoing reasons, this Writ Petition is disposed of by directing the petitioner to submit her representation to the 5th respondent seeking for cancellation of patta for the property morefully disclosed in the prayer to this Writ Petition now standing in the name of the 8th respondent, within a period of two weeks from the date of receipt of a copy of this order, along with supporting documents. On receipt of said representation by the 5th respondent within the stipulated time, the 5th respondent shall pass final orders on merits and in accordance with law on the said representation, after hearing the objections of the respondents 8 - 11 and any other third party, whom the 5th respondent deems it fit to enquire, within a period of twelve weeks from the date of receipt of a copy of this order.
