Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 06.10.2023 for rectification of errors crept in the patta which was wrongly issued to the 8th respondent in respect of the lands measuring an extent of 1.04 acres (0.42.0 Hectares) comprised in Survey No.34/1, situated at Santhapuram Agraharam Village Hosur Taluk, Krishnagiri District and issue patta to the petitioner within the time to be stipulated by this Court.

ORDER

This Writ Petition is filed seeking to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 06.10.2023 for rectification of errors crept in the patta which was wrongly issued to the 8th respondent in respect of the lands measuring an extent of 1.04 acres (0.42.0 Hectares) comprised in Survey No.34/1, situated at Santhapuram Agraharam Village Hosur Taluk, Krishnagiri District and issue patta to the petitioner within the time to be stipulated by this Court.

2. The learned counsel for the petitioner submitted that it would suffice if a direction is issued to the 1st respondent to consider the petitioner's representation dated 06.10.2023 within a time as may be fixed by this Court.

3. Mr.S.J.Mohamed Sathik, learned Government Advocate takes notice for the respondents 1 to 3. Since no adverse order is being passed against the respondents 4 to 8, notice to the respondents 4 to 8 is dispensed with.

Having regard to the submissions made by the learned counsel on either side and since this writ petition is filed seeking a simple writ of mandamus to consider the petitioner's representation, this Court without expressing any opinion with regard to the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 06.10.2023 and issue notice to the petitioner, respondents 4 to 8 herein, adjacent land owners of the four boundaries of the subject property and also to the interested parties/rival claimants/objectors/aggrieved parties if any, as the 3/6

case may be and after issuing notice to all the parties, conduct enquiry in the manner known to law and pass orders on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order.

5. With the above directions, this Writ Petition is disposed of at the admission stage itself. There shall be no order as to costs. 29.02.2024 ksa-2 Index : Yes / No Speaking Order : Yes / No 4/6
