Respondents Prayer:- Writ petition has been filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus for bearing the respondent No.2 and his subordinates from interfering with the Civil disputes between the petitioners and the respondent No.3 and consequently to direct the respondents to take appropriate action on the representation of the petitioners dated 18.02.2019.

O R D E R

This writ petition has been filed seeking for bearing the 2nd respondent and his subordinates from interfering with the Civil disputes between the petitioners and the 3rd respondent. In this regard, the petitioner also sent a representation to the 1st respondent on 18.02.2019, which is pending from the 1st respondent.

2.In view of the prayer sought for by these petitioners, the 2nd respondent is directed not to interfere with the civil dispute between the petitioners and the 3rd respondent. Further, it is seen that the 2nd respondent issued notice under Sections 160 & 91 of Cr.P.C to the petitioners herein, thereby, called upon them to attend the enquiry on 17.11.2018. On such notice, the petitioners were also appeared before the 2nd respondent for enquiry.

3. If at all any prima facie case is made out as against the petitioners, it is left open to the 2nd respondent to initiate proceedings as contemplated under the law. Further, if any civil dispute arises between the petitioners and the 3rd respondent, they can very well work out their remedy before the competent Civil Court.

4.With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petitions are also closed.
