3. Hence, and for the reasons set out in the accompanying affidavit, the delay of 37 days in filing the Original Side Appeal is condoned and this Miscellaneous Petition is ordered.

4. Registry is directed to number the Original Side Appeal, if it is otherwise in order, and list the same for admission.
