When the matter was taken up for hearing, learned counsel for the petitioner sought permission of this Court to withdraw the present writ petition with a liberty to file a civil suit by excluding the delay pending of the writ petition and he has also made an endorsement to that effect in the case bundle.

2. Learned counsel for the petitioner would further submit that he came to know about the cancellation of the sale deed only in the month of October 2017 and thereafter, he has filed a writ petition in the month of January 2018 i.e., on 05.01.2018.

3. In view of the above submission coupled with an endorsement made by the counsel for the petitioner, this Writ Petition is dismissed as withdrawn with a liberty to approach the Civil Court and the Civil Court may exclude the pending period from the date of filing the writ petition dated 05.01.2018 to till date i.e., 12.06.2024. No costs.
