PRAYER: Second Appeal filed under Section 100 of the Civil Procedure Code, against the Judgment and Decree dated 22.11.2011 passed by the learned Additional District Judge (Fast Track Court - III), Vridhachalam in A.S.No.78 of 2010, modifying the Judgment and Decree dated 21.01.2010 passed by the learned Principal Sub Judge, Vridhachalam in O.S.No.97 of 2005.

J U D G M E N T

This Second Appeal has been filed to set aside the Judgment and Decree dated 22.11.2011 passed by the learned Additional District Judge (Fast Track Court - III), Vridhachalam in A.S.No.78 of 2010, modifying the Judgment and Decree dated 21.01.2010 passed by the learned Principal Sub Judge, Vridhachalam in O.S.No.97 of 2005.

2. The learned Counsel for the Appellants filed a memo stating that the parties to the Second Appeal had settled the dispute among themselves, since the subject matter of the Appeal is partitioned. Therefore, they had withdrawn the Appeal. The memo filed to that effect and the memo is recorded.

In the result, this Second Appeal is dismissed as withdrawn. No order as to Court fee.
