Respondent Criminal Original Petition filed under Section 482 Cr.P.C., to direct the respondent police not to harass the petitioner in night and day to come to the Police Station for the past 5 days instead of taking action on the petitioner's complaint dated 01.05.2016 against said culprit Mr.Loganathan, running a finance company in the name of Rajalakshmi Agencies at 125/1, Thambu Chetty Street, Chennai-1.

This petition has been filed to direct the respondent not to harass the petitioner.

2. On account of boycott of Courts, there is no representation on the side of the petitioner. However, in Harish Uppal [Ex.Capt.] Vs Union of India reported in [2003] 2 SCC 45, the Hon'ble Supreme Court has held that boycott of Courts is illegal and therefore, this Court went through the records and passed orders, on hearing the learned Additional Public Prosecutor.

3. Learned Additional Public Prosecutor submitted that on the complaint lodged by one A.L.G.Loganathan against this petitioner, petition enquiry is pending before the respondent police in CSR.No.222 of 2016.

4. In view of the above, the petitioner is directed to cooperate with the police for enquriy and at the time of conducting enquiry, the petitioner shall not be harassed. During the course of enquiry, if any cognizable offence is made out, the respondent police is free to register an FIR and this order shall not be a shield for the petitioner against arrest.
