ORDER

The petitioner has filed this Writ Petition praying for issuance of a Writ of Mandamus to direct the first respondent to issue Destitute Widow Certificate, as per the petitioner's representation, dated 13.10.2014.

2. The petitioner is a widow; her husband died in the year 1998 and having one daughter and she has no support from her family members. She has studied upto 5th Standard. In order to get priority in any of the Government job like noon meal assistant, cook or peon and other social welfare measures, the petitioner applied to the first respondent for Certificate of Destitute Widow. It is her further case that the second respondent already certified that the petitioner is a widow and eligible for the said Certificate. Therefore, she made a representation, dated 13.10.2014 to the first respondent, along https://hcservices.ecourts.gov.in/hcservices/

with ration card, legal heir certificate, etc. It is further stated by the petitioner that similarly placed persons applied for the said Certificate and got the same. Though the first respondent forwarded the said representation to the second respondent for field enquiry, so far nothing has been done. Hence, the petitioner has filed this Writ Petition for the above relief.

3. Heard both sides.

Taking into consideration the factual aspects of the matter, this Court, without going into the merits of the case, directs the first respondent to consider the said representation of the petitioner, dated 13.10.2014, conduct enquiry, afford an opportunity of personal hearing to the petitioner and necessary parties, pass appropriate orders and dispose of the said representation, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and it is for the first respondent to decide the same.

5. With the above observations and directions, the Writ Petition is disposed of. No costs.
