Hence, the 2nd defendant is set exparte.

2. On perusing the pleadings and upon hearing the counsel the following issues are framed for consideration in the suit for trial:

1. Whether the plaintiff is entitled to recovery of a sum of Rs.1,12,87,876/- with interest at 21.6% per annum allegedly due under the mortgage dated 09.01.1996?

2. Whether the plaintiff is entitled to personal decree against the defendants for the balance amount?

3. To what other reliefs the plaintiff is entitled?

2. List of witnesses and affidavit of documents to be filed by 19.07.2019. Upon such filing, Registry is directed to post the matter before the learned Additional Master-II for evidence on 01.08.2019.
