The present Civil Miscellaneous Petition has been filed to condone the delay of 935 days caused in filing an Application to set aside the order of dismissal date 09-06-2015 in A.S. No 529 of 2006.

2. When the matter was taken up for hearing on 06.04.2026, there was no representation on the side of the petitioner, either in person or through the learned counsel. In order to grant one more opportunity, this Court directed the Registry to list the matter on 07.04.2026 (today) under the caption "For Dismissal".

3. Even today, when the matter was taken up, there is no representation on the side of the petitioner. Hence, it is evident that the petitioner is not interested in prosecuting the matter.
