Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to pass an interim order of Direction, directing the respondents to sanction the pensionary benefits with effect of pension and arrears of pension as granted in the proceedings order No.Pa.Tho.No.A1/18518/2007 dated 06.06.2019 passed by the 2nd respondent(WMP.NO.5986/2022)pending disposal of the WP.NO.5883/2022 Order : This Miscellaneous petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.MEENAKSHI, Advocate for the petitioner and of MR.R.BHARATH KUMAR, Standing Counsel on behalf of the Respondents, the court made the following order:- The petitioner herein filed the present writ petition challenging the orders passed by the 2nd respondent dated 06.06.2019 and also seeking monetary benefits of his promotion to the post of Junior Assistant with effect from 02.04.2014.
2. The petitioner has also filed an interim application seeking settlement of the retirement benefits to him. According to the petitioner, he retired from service, on 31.05.2017, But, till now, the respondents have not paid the retirement benefits. Therefore, this court is of the view that there is no impediment for the respondents to grant retirement benefits to the petitioner https://hcservices.ecourts.gov.in/hcservices/
3. Accordingly, the 2nd respondent is directed to consider the petitioner's representation dated 19.10.2020 and pass orders on its own merits, in accordance with law, as expeditiously as possible within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish the copy of this order along with the representation.
