ORDER
This Petition has been filed seeking to call for the records of the proceedings in PRC No.115 of 2017 on the file of the II Metropolitan Magistrate, Egmore, Chennai and quash the same. 2.The case of the prosecution is that the petitioner and one Jeevanantham(A1) were studying M.L. Degree in the University of Madras, whereas the 2nd respondent, is none other than the Head of the Department of Legal Studies. While so, on 24.03.2016 at about 4.00 P.M, the petitioner along with other accused namely Jeevanandham allegedly went to the 2nd respondent's chamber and attacked the defacto complainant by using filthy language. Further, in the said incident, the 2nd respondent sustained injury and later he was discharged from the hospital. Hence, the case has been registered and after filing the final report, it was taken as PRC No.
115 of 2017 on the file of the II Metropolitan Magistrate, Egmore, Chennai. 3.Already, the petitioner filed a petition in Crl OP No.28943 of 2019 before this Court, seeking to quash the entire proceedings in PRC No.115 of 2017 on the file of the II Metropolitan Magistrate, Egmore.
vide order dated 05.04.2023, dismissed the petition. Now the present petition has been filed on the ground that the first accused filed a quash petition before this Court in Crl OP No.27480 of 2022 and the same was allowed by this Court on 29.10.2024. Therefore, according to the petitioner, there is change in circumstances and hence the petitioner filed this petition to quash the entire proceedings in PRC No.115 of 2017 pending against him.
4.However, it is pertinent to note that the proceedings against the first accused came to be quashed by this Court vide order dated 29.10.2024 on the ground of compromise. It appears that there was a compromise entered into between the first accused and the second respondent herein and recording the same, this Court quashed the proceedings. However, there is no compromise between the petitioner and the second respondent herein and the second respondent wants to proceed the case as against the petitioner. Therefore, there is absolutely no change in circumstances to entertain this petition to quash the proceedings pending against the petitioner. That apart, there are specific allegations made as against the petitioner, which have to be probed into by way of full fledged trial.

5.In view of the above, this Court finds that there is no merit in this case and accordingly, this Criminal Original Petition is dismissed. The committal Court is directed to complete the committal proceedings in PRC No.115 of 2017 within a period of two weeks from the date of receipt of a copy of this order. On receipt of the entire bundle from the learned Magistrate, the trial Court is directed to complete the trial within a period of six months from the date of receipt of the case records. Consequently, connected miscellaneous petition is closed.
