ORDER

By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed seeking to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 03.02.2022 and grant promotion as Junior Engineer Grade-II in the Tuticorin Thermal Power Station within the time stipulated by this Court.

3. The case of the petitioner in brief:

The petitioner herein was originally appointed as Helper in Tuticorin Thermal Power Station and he was promoted to the post of Assistant Operator and thereafter he was promoted as Foremen Grade-II and further he was promoted to the post of Foremen Grade-I.

3.1. The petitioner has acquired qualification and sufficient training and experience pertaining to the post of Junior Engineer Grade-II . For selection of Junior Engineer Grade-II, the ratio of 3:1 between diploma holders technical Assistance and RWE Foremen Line Inspector (LI or Foremen GradeII) has to be followed. The petitioner has given a representation dated 03.02.2022 to the respondents to promote him to the post of JE Grade-II. But no orders has been passed and the said representation is still pending and the respondents are not following the ratio for grant of promotion to the nondiploma holders and also periodic seniority list and promotion panel is not being prepared. Hence, this writ petition.

4. The learned Standing Counsel appearing for the respondents submitted that, the representation of the petitioner will be considered and orders will be passed on its own merits and in accordance with law.

5. Inview of the above submissions and also considering the limited scope of prayer, without expressing any opinion on merits, this court passes the following order. i) The respondents are directed to consider the representation of the petitioner dated 03.02.2022 and pass orders on its own merits, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
