Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time to execute the sureties in Crl.O.P.No.32341/2019 dated 02.12.2019.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.SUBASH, Advocate for the petitioners, and of MR. K.PRABAKAR, Additional Public Prosecutor, on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed, seeking extension of time to execute the sureties, as directed by the order, dated 02.12.2019 made in Crl.OP.No.32341 of 2019. 1.Heard both sides.

2.It is seen that the order copy was made ready on 11.12.2019. The Petitioners ought to have surrendered within 15 days from the date of receipt of a copy of the order i.e. on or before 26.12.2019 or he should have filed the petition for extension of time to execute the sureties, before the expiry of the said period, but the Petitioners have failed to do so.

This court, in the order dated, 02.12.2019, in clause (b), had clearly stated that if the Petitioners fail to surrender within 15 days from the date of receipt of a copy of the order, the order shall https://hcservices.ecourts.gov.in/hcservices/

stand cancelled automatically. Now, as on date, since the Petitioner did not surrender within the stipulated time, the order has been cancelled automatically. Hence, extension of time cannot be granted. Accordingly, this Criminal Miscellaneous Petition is dismissed. However, the Petitioners are at liberty to file a fresh application, seeking anticipatory bail.
