Respondents Prayer:- Civil Revision Petition filed under Article 227 of Constitution of India, to issue direction directing the learned Additional Subordinate Judge, Kancheepuram to dispose of the case in A.S.No.36 of 2017 within the time frame fixed by this Court by allowing this Civil Revision Petition.

For Petitioner : Mr.A.Saravanan 1/4

O R D E R

Heard the learned counsel appearing for the petitioner and perused the materials available on record.

2. The petitioner, who succeeded as plaintiff before the Trial Court in obtaining a decree for injunction, has filed the present Civil Revision Petition seeking a direction for expeditious disposal of A.S.No. 36 of 2017 preferred by the defendants and pending on the file of the learned Additional Subordinate Court, Kancheepuram.

3. The learned counsel for the petitioner submitted that though the decree was passed as early as on 05.04.2017, on account of the pendency of the appeal from the year 2017, the petitioner is unable to enjoy the fruits of the decree.

4. Considering the limited relief sought for, this Court is inclined to entertain the present Revision and dispense with notice to the respondents, as no prejudice would be caused to them by issuance of a direction for early disposal. Accordingly, this Civil Revision Petition is allowed and the learned Additional Subordinate Judge, Kancheepuram, is 2/4

directed to dispose of A.S. No. 36 of 2017, along with A.S. Nos. 38 and 40 of 2017, on merits and in accordance with law, on or before 30.06.2026. No costs.
