Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1st respondent to take appropriate action for providing protection in execution of the welfare scheme i.e. construction of flood barrier wall, the work which was awarded by the 4th respondent on 01.11.2013. By consent the writ petition is taken up for final disposal.
2.The petitioner who claims to be the president of S.Nallur Village Panchayat would state that he has involved himself in public works for the last two decades and earned good reputation from the residents of his village. He was carrying out various welfare activities for the benefit of the people. The petitioner would further state that funds have been allotted from the Government under the Mahatma Gandhi National Rural Employment Assurance scheme for putting up construction of flood barrier wall. The Block Development Officer have also called for tender in his proceeding No.2437/2013/B3 dated 1.11.2013. He would further state that some of the miscreants have encroached the land and road upon which the flood barrier wall is to be constructed. In this regard he submitted a letter to the Sub Collector and the fourth respondent on 04.01.
2014 and the encroachments have been removed on 11.09.2014. The petitioner would further state that though the encroachments were removed again and again the miscreants are obstructing the construction of the wall and he sent a representation dated 13.09.2014 to the first respondent and also submitted a representation dated 18.11.2015 to the Hon'ble Deputy Speaker with copies marked to the Collector. Since he has not been favoured with any response, he came forward to file this writ petition.
3.Heard the submissions of Mr.D.Selvaraju, learned counsel appearing for the petitioner and Mr.Era Premnath, learned Government Advocate appearing for the respondents.
4.Though the petitioner prayed for a larger relief, this Court taking into consideration the facts and circumstances, directs the first respondent to consider and dispose of the representation dated 13.09.2014 in accordance with law, taking into consideration the work order issued by the first respondent in No.2437/2013/B2 dated 01.11.2013 and pass orders as expeditiously as possible and not later than four weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner.
