The petitioner, who was arrested and remanded to judicial custody on 11.11.2022 for the alleged offence under Sections 8(c), 20(b)(ii)(B) of NDPS Act 1985 read with Section 328 of IPC in Cr.No.149 of 2022 in C.C.No.1 of 2023 seeks bail.

2. The case of the prosecution is that on 11.11.2022, based on the secret information the respondent police went to the scene of occurrence and intercepted the vehicle bearing registration No.TN13 J 2162 and found the petitioner with illegal possession of 5.500 Kg of ganja. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he is in judicial custody from 11.11.2022. He further submits that he is ready and willing to abide by any of the stringent conditions imposed by this Court. Hence prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the petitioner is detained under "Drug Offender" as contemplated under Section 2(e) of the Tamil Nadu Act 14 of https://www.mhc.tn.gov.in/judis 1982. Hence he raised strong objection for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the petitioner is detained under "Drug Offender" as contemplated under Section 2(e) of the Tamil Nadu Act 14 of 1982, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. .
