ORDER

This petition has been filed seeking to grant leave to the applicant/plaintiff to file the present suit as against the respondents / defendants 1, 5, 6, 7 & 8 before this Court.

2. According to the applicant, he is the plaintiff in the main suit filed for

declaration and injunction and the suit property is situated within the jurisdiction of this Court and the only the respondents 1, 5, 6, 7 & 8 are residing outside the jurisdiction of this Court, thereby pleaded to allow the present application.

3. Heard the learned counsel for the applicant and perused the documents placed on record.

4. Considering the fact that the applicant/plaintiff has filed the present suit for declaration, permanent injunction, for damages and costs and taking note of the fact that the suit property is situated within the jurisdiction of this Court and the cause of action arose within the jurisdiction of this Court and the respondents 1, 5, 6, 7 & 8 are residing outside the jurisdiction of this Court, therefore, the present application deserves to be allowed and accordingly, the same is allowed. Leave is granted.
