No.1615/1998/A3 dated 14.01.2004 on the file of the 2nd respondent, within a time frame that may be stipulated by this Court.

Heard learned counsel for the petitioner and learned Government Advocate for the respondents.

The petitioner prays for a Mandamus directing the respondents 3 & 5 to dispose its representation dated 23.01.2021 seeking waiver of interest and penalty, though admitting the tax liability and undertaking to remit the arrears. Since the prayer is short, I had directed on 19.03.2020, R3 & R5, being Assistant Commissioner (ST), Salem, and the Joint Commissioner, Salem, to consider the representation of the petitioner and dispose the same.
3. Today, the provisions of Section 16-B of the Tamil Nadu General Sales Tax Act, 1959 (in short 'Act') are brought to my notice, as per which, the power to reduce or waive penalty in certain circumstances, stand vested in the Commissioner of Commercial Taxes. Thus the petitioner is permitted to seek waiver of interest and penalty before the Authority stipulated under Section 16-B of the Act. Representation filed by the petitioner, if and when filed, shall be accompanied by a copy of this order and shall be considered by the Commissioner, in accordance with law and disposed within a period of six (6) weeks from the date of representation, after hearing the petitioner.
