Today when the matter is taken up for hearing, the learned counsel appearing for both the parties submit that the dispute between the parties has been settled out of Court and hence, the Second Appeal may be closed. To that effect, the learned counsel for the appellant also made an endorsement in the bundle.

2. Recording the submission and the endorsement, the Second Appeal is closed. The appellant is entitled to refund of Court fee as per law. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
