PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, to issue suitable direction to dispose of the suit in O.S.No.1312 of 2019, pending on the file of the III Additional District Munsif Court, Coimbatore, within a reasonable period.

O R D E R

The limited prayer sought for in this petition is for a direction to the trial Court to dispose of the suit in O.S.No.1312 of 2019, within the stipulated period.

2. The petitioner/plaintiff herein had filed the suit in O.S.No.68 of 2015, seeking for declaration that the plaintiff/petitioner S.Latha is the legal daughter of the defendants 1 & 2, and to grant cost of the suit. 3.

Heard the learned counsel for the petitioner and perused the materials placed before this Court.

4. On a perusal of the adjudication orders, it is seen that the suit summons were served. The matter is now kept pending for filing of written statement from 30.01.2020 till date. The entire nation has been facing the difficult situation of lock down for the past one year. Due to the emergent situation, the Court below could not proceed further in this matter. Now, this Court is not inclined to direct the Court below to consider the suit within a time frame.

Hence, there shall be a direction to the learned III Additional District Munsif, Coimbatore, to give a last chance to the parties to file their written statement within a period of four weeks from the date of the first hearing of the suit after receipt of copy of the order and then proceed further to dispose of the suit in O.S.No.1312 of 2019, as expeditiously as possible as per the procedure established under law. 6.

Accordingly, the Civil Revision Petition stands disposed of. No costs.
