N.K.Suresh Kumar .. Respondent Civil Revision Petition filed under Article 227 of the Constitution of India, praying to direct the XIV Judge, Small Causes Court, Chennai, to dispose of R.C.O.P.No.2010 of 2014 pending on his file, within a time frame.

ORDER

The petitioners who are the owners of the property in question, has filed R.C.O.P.No.2010 of 2014 for fixation of fair rent before the Small Causes Court, Chennai. The respondent/tenant appeared and took time for filing counter affidavit. The matter is being dragged on without filing counter. It is stated that the tenant was taking time since December 2014 for counter. Even after many hearings, no counter is filed till date. The proceedings are being prolonged without adjudication of the main relief of

fixation of fair rent and pending R.C.O.P., many frivolous and vexatious interlocutory applications were filed, which is evident from the docket orders passed by the Court below. Hence, the petitioner has filed this petition for the early disposal of the main R.C.O.P. Taking into consideration the above facts and circumstances and also taking into account the fact that the R.C.O.P. for fixation of fair rent is pending since 2014, this Court deems it fit to grant time for early disposal of R.C.O.P. Accordingly, the learned XIV Judge, Small Causes Court, Chennai is directed to dispose of R.C.O.P.No.2010 of 2014, before 30.06.2017. With this direction, the Civil Revision Petition is disposed of. No costs. 02.02.2017 cs Copy to The XIV Judge, Small Causes Court, Chennai.
