ORDER

The case of the prosecution as per the defacto complainant is that, there was a dispute between two rival groups with regard to dancing in a temple festival; that the petitioner along with others assaulted the defacto complainant with knife and beer bottles. Hence, the case.

2. This is the second anticipatory bail petition. The petitioner was granted anticipatory bail earlier in Crl.O.P.No.21783 of 2022 dated 09.09.2022.

3. The petitioner had not executed surety in terms of the said order and the petitioner's application for extension was also dismissed.

4. Learned counsel for the petitioner submitted that the respondent has not filed charge sheet. He further submitted that the petitioner is willing to appear before the trial Court regularly.

5. Learned Government Advocate on instructions submitted that the final report has been filed and the summon has been issued to the petitioner and the next hearing date is 26.03.2025 before the trial Court.

6. Since the petitioner had not complied with the earlier order, this Court is not inclined to entertain this anticipatory bail petition. However, since the final report has already been filed, it is open to the trial Court to direct the petitioner to execute bond in terms of Section 88 of Cr.P.C., on the next hearing date.
