This writ petition has been filed, seeking to call for the records of the impugned order dated 18.09.2012 passed by the 3rd respondent herein and quash the same consequently direct the respondents to reinstate the petitioner as water Tank Operator at Katheri Panchayat, Samiyarpalayam (Post), Sangagiri Taluk, Salem District.
2. Today, when the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents submitted that after the termination of the petitioner from his service from the third respondent/Katheri Panchayat, one person was appointed temporarily as Over Head Tank Operator for discharging the duties. Even that person also did not come to work regularly, hence the third respondent/Katheri Panchayat again engaged the petitioner as Over Head Tank Operator and he is working as a Over Head Tank Operator in the third respondent/Katheri Panchayat till date.
3. The learned Additional Government Pleader further submitted that Page No.2 of 4
the third respondent/Katheri Panchayat has also passed a resolution bearing No.222/4 dated 19.03.2010. The said resolution copy along with the recommendation letter was sent to the Block Development Officer/2nd respondent on 06.10.2022 recommending the petitioner's name for appointing him as an Over Head Tank Operator in the third respondent/Katheri Panchayat.
4. In view of the above, Block Development Officer, Sangagiri Taluk, Salem District/2nd respondent is hereby directed to pass orders on the recommendation made by the third respondent vide letter dated 06.10.2022 within a period of four weeks from the date of receipt of a copy of this order.
5. This writ petition is disposed of with the aforesaid direction. No costs. Consequently connected miscellaneous petition is also closed. 23.01.2024 dpq Index :
