ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 31.01.2021 for the offence under Sections 376, 313, 354A(1)(ii), 417, 406, 506(1) of IPC and 67 A of Information Technology Act, in Cr.No.06 of 2020 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner had illegal relationship with the defacto complainant and on the terms that he will marry her received a sum of Rs.40 Lakhs from her and thereafter refused to marry her and also not returned the money. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and further submitted that the defacto complainant is 30 years old whereas the petitioner is only 23 years old and that there is age difference and only inorder to grab money from the petitioner, a false case has been registered against the petitioner. 4.The learned Additional Public Prosecutor submitted that investigation is still pending.

5.Considering the allegation against the petitioner that he received a sum of Rs.40 Lakhs from the defacto complainant and has not returned the money, I am not inclined to grant bail to the petitioner.
