The petitioner who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 420, 120-B, 109 and 506(ii) of IPC in Crime No.2 of 2023, seeks anticipatory bail. 2.The case of the prosecution as per the defacto complainant is that the petitioner was running a company called Euronexus Immigration Limited engaged in sending job aspirants to foreign countries. Based on the facebook advertisement, the defacto complainant have paid a sum of Rs.7 lakhs to the petitioner for getting a job in abroad, whereas, even after lapse of three months, the petitioner neither arrange the job for the defacto complainant nor return the money. The further allegation is that when it was questioned by the defacto complainant, the petitioner has threatened him with dire consequences. Hence the complaint. 3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner has

forwarded the amount obtained from the defacto complainant to one Mubeesh Ahmed, who is running a travel agency. The said Mubeesh Ahmed failed to obtain work visa for the defacto complainant, for which, the petitioner has also lodged a complaint. He would further submit that he has nothing to do with the alleged offence and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner on the false promise of getting job in abroad, cheated the defacto complainant to the tune of Rs.7 lakhs and when it was questioned by the defacto complainant, the petitioner has threatened him with dire consequences. He further submitted that the investigation is still pending. Hence, he opposed for grant of anticipatory bail to the petitioner. 5.Considering the facts and circumstances of the case and also the submissions made by the learned counsel and the investigation is still

pending, this court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this Criminal Original Petition is dismissed. 02.03.2023 vkr
