Respondent/Defendant Prayer: This Second Appeal has been filed under Section 100 of the Code of the Civil Procedure, against the judgment and decree dated 16.08.2011 in A.S.No.24 of 2011 on the file of the Hon'ble 1st Additional District Judge, Coimbatore reversing the judgment and decree passed by the Principal Subordinate Judge, Coimbatore made in O.S.No.689 of 2008 dated 27.04.2010.

Decree : This Second Appeal coming on for hearing on Friday the twenty third day of July 2021, upon perusing the grounds of Appeal, the judgments and Decrees of the Lower Appellate Court and the Court of First instance and the material papers in the suit and upon hearing the arguments of Mr.C.Ravichandran, Advocate, for the Appellant, and of Mr.A.Selvanambi for Mr.A.Ramaswamy, Advocate for the Respondent, and this case having stood over for consideration till this day, it is ordered that the decree of the Lower Appellate Court be and hereby is set aside and the case is remanded to the trial Court and that the Subordinate Judge, Coimbatore, do restore the Suit in OS No.689/2008 to its original number in the register and proceed to dispose of the case in the light of he observations and directions and directions contained in the judgment herein and that there be no costs.
