O R D E R

The only effect of my order dated 28.6.2012 passed in W.P.No.9480 of 2011 was to set aside the recovery of the excess payment on the sole ground that an excess payment made not due to any misrepresentation or fraud on the part https://hcservices.ecourts.gov.in/hcservices/

of the employee, cannot be recovered. I did not go into the question whether the revision of the pay scale was correct or not. Therefore, G.O.(2D) No.15, School Education dated 23.5.2014 giving up the amount of recovery is perfectly in tune with my order passed. Therefore, the contempt petition is closed. Since the question of correctness of the fixation of pay was not dealt with by me in my order dated 28.6.2012, the petitioner should work it out separately and not in the form of this contempt petition.
