Prayer in W.P.No.7065 of 2026 : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent Bank not to take any further steps in view of the pendency of the Appeal in M.A. (SA) Diary No.44 of 2026 filed on 07.01.2026 against orders passed in SA No.824 of 2025 dated 08.12.2025.
Prayer in WP No. 7074 of 2026 : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the Honble DRAT to allow the redemption of the property by depositing the amount of Debt Due as per the statute within the time framed fixed by this Honble Court, after complying with any condition that may be imposed initially to entertain and adjudicate on merits the appeal in M.A. (SA) Diary No.44 of 2026 filed on 07.01.2026 against order passed in SA No.824 of 2025 dated 08.12.2025.

ORDER
(Order of the Court was made by R.Suresh Kumar J.) Since the issue raised in both these writ petitions is one and the same, these writ petitions are taken up for hearing and are disposed of by this common order.
2. In view of the order that is going to be passed at the admission stage, notice to the respondent is hereby dispensed with.
3. As against the SARFAESI proceedings initiated by the respondent bank, the petitioner has moved the Debts Recovery Tribunal (DRT) at Chennai, where he lost the SARFAESI application, as against which, he preferred a SARFAESI Appeal in M.A. (SA) Diary No.44 of 2026 filed on 07.01.2026. The said appeal is yet to be numbered despite the statutory compliance being made by the petitioner. Therefore, at this juncture he moved the present writ petitions with the aforesaid prayers.
4. Heard the learned counsel for the petitioner. He would submit that, within a time frame if the SARFAESI appeal is numbered, then his grievance would be redressed as he would agitate the issue before the Debts Recovery Appellate Tribunal (DRAT), Chennai in the manner known to law.
5. Recording his submission, this writ petition is disposed of with a direction to the DRAT, Chennai to look into the matter with regard to the numbering process of M.A.(SA) Diary No.44 of 2026 filed on 07.01.2026, if it is otherwise in order and number the same within a period of fifteen (15) days from the date of receipt of a copy of this order. Till such time, the respondent bank shall not take any coercive steps under the provisions of the SARFAESI Act.
6. With the above directions, these writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed. (R.S.K.,J.)
