This application is filed to reopen the applicant/plaintiff's side evidence in T.O.S No.3 of 2022 to examine Mr.Vijayakumar as the petitioner's side witness PW3.

2. The learned counsel for the respondent/defendant has strongly opposed to allow this application stating that after conducting the DW1 cross examination, only to fill up the lacunae, the present application is filed.

3. Considering the facts and circumstances of the case and having satisfied with the reasons stated in the affidavit, this Court is inclined to allow this application.

4. Accordingly, this application is allowed.
