When the matter is taken up for hearing on 19.08.2024, the learned counsel appearing for the sole appellant reported that they have given change of vakalat to the appellant and also reported "no instructions". Hence, this Court directed the Registry to verify as to whether any counsel has been engaged by the appellant to pursue the case and also directed to serve notice to the appellant in this regard.
2. As per the direction of this Court, notice was sent to the appellant and the same was returned stating that he was died.
3. Today, when the matter is taken up for hearing, it is seen that neither any counsel entered appearance for the appellant nor any petition filed for taking steps to set aside the abatement caused due to the death of the sole appellant. Accordingly, the Second Appeal is dismissed as abated. No order as to costs. Consequently, the connected Miscellaneous Petition stands closed.
