Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.V.RAJAMOHAN, Advocate for the petitioner and of MR.R. RAVICHANDRAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned Chief Judicial Magistrate cum Special Judge, Erode, in Spl.C.C.No.5 of 2015 dated 24.08.2017 and enlarge the petitioner on bail pending disposal of the criminal appeal, the petitioner is before this Court with this petition.
2. Heard Mr.V.Rajamohan, learned counsel for the petitioner and Mr.R.Ravichandran, learned Government Advocate (Crl.side) appearing for the respondent.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is allowed and the substantive sentence of imprisonment alone is suspended and the petitioner is released on bail on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties each for a like sum to the satisfaction of the Chief Judicial Magistrate cum Special Judge, Erode District, Erode. Further, the petitioner shall appear before the trial Court on 15th of every month at 10.30 a.m until further orders.
