This criminal original petition has been filed to quash the proceedings of the complaint filed by the respondent / complainant under Section 138 of the Negotiable Instruments Act against the petitioner / accused in CC.No.5878 of 2016 on the file of the Fast Track Court No.III, Saidapet 2.
The learned counsel for the petitioner submitted that even before the trial court itself, the complaint was withdrawn on the ground of 'settled out of court'. Therefore, he seeks permission of this Court to withdraw the criminal original petition and he has also made on endorsement to that effect. 3.
