O R D E R

This Criminal Miscellaneous Petition has been filed seeking relaxation of condition 6 (ii) imposed by this Court vide order dated 15.07.2024 in Crl.M.P.No.9907 of 2024 in Crl.A.No.888 of 2024. 2.

It is submitted by the learned counsel for the petitioner/appellant that this Court, while granting suspension of sentence to the petitioner, vide order dated 15.07.2024, imposed a condition directing the petitioner to appear before the trial Court on the first working day of every calendar month at 10.30 a.m., until further orders. It is further submitted that the petitioner is suffering from psychiatric illness and is undergoing treatment and therefore, finds it difficult to travel from Kancheepuram to the trial Court every month. Hence, he prayed to relax the said condition.

Considering the submissions made by the learned counsel appearing on either side and upon perusal of the materials available on record and also taking note of the reasons adduced in the affidavit filed in support of this petition, this Court is inclined to modify condition 6 (ii) imposed by this Court.

Accordingly, condition 6(ii) imposed by this Court in Crl.M.P.No.9907 of 2024 in Crl.A.No.888 of 2024 dated 15.07.2024 is modified to the effect that the petitioner/appellant shall appear before the trial Court once in four months at 10.30 a.m., commencing from the 1st working day of April 2026, until further orders. 5.

With the above modification, this Criminal Miscellaneous Petition stands disposed of.

It is made clear that in the event of the petitioner not being able to appear before the trial Court concerned on the specified date, she shall be duly represented by her counsel, who shall file an application under Section 317 Cr.P.C before the trial Court concerned and the petitioner shall appear before the trial Court on such other date(s) as directed by the trial Court.
