PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 5th respondent to pass a final order on the petitioner's representation dated NIL seeking for appointment on compassionate grounds which is forwarded to him by the Assistant Executive Engineer vide letter dated 09.12.2021 with all the clarifications that were sought for by him, within a time frame as may be fixed by this Court. ORDER

The writ petition has been filed for the following relief : " To issue a Writ of Mandamus directing the 5th respondent to pass a final order on the petitioner's representation dated NIL seeking for appointment on compassionate grounds which is forwarded to him by the Assistant Executive Engineer vide letter dated 09.12.2021 with all the clarifications that were sought for by him, within a time frame as may be fixed by this Court."

2. The case of the petitioner is that her husband Mani had joined the respondent-Board as contract labourer on 13.09.2007. Thereafter, vide proceedings of the 4th respondent dated 20.7.2009, her husband's name was referred to the post of Temporary Casual Labourer, which subsequently was dropped out temporarily, on account of his alleged involvement in a theft, which

ultimately had ended in an acquittal. Thereafter, the petitioner's husband had submitted representations to the Board on 01.11.2012, 22.05.2012, 24.12.2025 and 07.06.2017 respectively, to provide him an employment. While so, on 24.07.2019, the petitioner's husband had passed away leaving behind his wife, the petitioner herein, two daughters and a son.

The petitioner thereafter had submitted a representation to the 1st respondent seeking appointment on compassionate grounds in the month of October 2021, subsequent to which, some internal correspondences took place amongst the respondents and thereafter, it came to a stand still. The petitioner had again knocked the doors of the respondent-Board vide her representations dated 14.02.2022, 15.02.2025 and 06.10.2025. The petitioner would submit that despite the respondents having received the said representations, have not taken any action on the same. Hence, the petitioner is before this Court.

4. Heard the learned counsel on either side and also perused the materials placed before this Court.

5. Considering the facts and circumstances of the case, a mandamus is issued to the 5th respondent to pass final orders on the petitioner's request for compassionate appointment, within a period of four weeks from the date of receipt of a copy of this order. If otherwise, in case of rejecting the petitioner's

claim, the 5th respondent shall do so, by passing a speaking order in accordance with law.
