Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the respondents to grant permission to the petitioners to peacefully protest in a permissible manner against the irregularities in the Valparai Municipality in front of Valparai Old Bus Stand at 12.00 p.m. on 23.02.2025 (Sunday) or on any Sunday preferably within 3 to 4 weeks there from and also to permit the petitioners to carry out loudspeaker campaign for two days prior to the permitted date of protest from vehicles inviting the concerned public to join the petitioners' protest and directing the respondents to provide protection to the petitioners' protest. O R D E R
This Writ Petition has been filed for directing the respondents to grant permission to the petitioners to peacefully protest in a permissible manner against the irregularities in the Valparai Municipality in front of Valparai Old Bus Stand at 12.00 p.m. on 23.02.2025 (Sunday) or on any 2/6
Sunday preferably within 3 to 4 weeks there from and also to permit the petitioners to carry out loudspeaker campaign for two days prior to the permitted date of protest from vehicles inviting the concerned public to join the petitioners' protest and directing the respondents to provide protection to the petitioners' protest.
2. Heard the learned counsel for both sides and perused the materials available on record.
3. The learned Government Advocate (Crl.Side) appearing for the first to third respondents, on instructions, would submit that there is likelihood of arising law and order problem.
4. A mere apprehension cannot be a ground to reject the permission. There is absolutely no material before this Court to hold that there will be a law and order problem in the event of permission being granted. In such view of the matter, this petition is allowed and the petitioner is permitted to protest in front of Valparai Old Bus Stand, however with the following conditions:- 3/6
(a) The protest in connection with the irregularities in the Valparai Municipality shall be conducted in front of Valparai Old Bus Stand at 12.00 p.m. to 5.00 p.m. on 23.02.2025 (Sunday); (b)The petitioner shall pay a sum of Rs.10,000/- (Rupees ten thousand only) as charges, to the respondents Police and on receipt of the same, the respondents Police are directed to issue receipt and proceed further.
(c)There should not be any kind of vulgar dialogues during the protest, by anyone of the participants;
(d) No flex boards in support of any political party or communal leader, shall be erected at the place of protest; (e) The protest shall not affect either religious or communal harmony;
(f) If there is violation of any one of the conditions imposed, the concerned police officer is at liberty to take necessary action, as per law and stop such performance forthwith;
(g) Similarly, the police is directed to stop the protest, if it is continued beyond the permitted time limit; and (h) The respondents Police are directed to issue necessary permission, incorporating the above conditions.
5. With the above directions, this Writ Petition is disposed of. The uploaded copy can be utilised for the purpose of execution of the Order. No 4/6
costs.
