ORDER
The petitioner, who was arrested and remanded to judicial custody on 21.01.2026, for the alleged offence punishable under Section 341, 294(b), 323, 394 r/w. 397, 506(ii) of IPC in Crime No.283 of 2024, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner herein was earlier arrested and released on bail and subsequently jumped bail. Hence, the Non Bailable Warrant was issued on 08.01.2026 and executed on 21.01.2026 and he was in custody.
3. The learned counsel appearing for the petitioner submitted that the petitioner has suffered illness, hence he was not able to appear before the Trial Court, hence a Non Bailable Warrant was issued, and is ready to co-operate with the trial process. Hence, he prayed to grant bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent Police reiterated the prosecution case and submitted that the petitioner is having 2 previous cases and if the petitioner is released on bail there is likelihood that he will indulge in similar activities. Hence, he opposed to grant bail to the him.
5. Considering the fact that the petitioner was earlier arrested and released on bail, and subsequently a Non Bailable Warrant was issued within short period, it has been executed and though the petitioner is having 2 previous cases, this Court is inclined to grant bail to the petitioner.
6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned XVII Additional District and Sessions Court, Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the Trial Court daily at 10.30 a.m., for a period of three weeks.
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial;
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
