ORDER

The petitioner has been arrayed as accused in Crime No.3581 of 2020 for the offences under Sections 294(b), 353 and 506(1) of IPC, and has filed the present petition to quash the FIR.

2. The contention of the petitioner is that, no such occurrence took place in the police station on 08.10.2020, as alleged in the complaint. The petitioner had earlier lodged a complaint on 17.09.2019 before the Director of Police, Anti-Land Grabbing Special Cell. However, no action was taken on the said complaint. Therefore, the petitioner has approached the Director General of Police, who in turn, forwarded a memo to the Superintendent of Police, Thiruvallur, to take action on the petitioner's complaint. Pursuant to which, the respondent police was directed to enquire into the matter. The petitioner as well as the counter petitioner were called for enquiry in C.No.355/DSP/ALGSC PP/Thiruvallur/2019, dated 22.08.2019 and the enquiry was conducted and closed on 08.10.

2020, stating that the petitioner should approach the Revenue Divisional Officer or the District Revenue Officer in respect of his complaint. Thereafter, it is alleged that, being aggrieved by the closure, dated 08.10.2020, the petitioner abused and threatened the Sub Inspector of Police/2nd respondent, and hence, the complaint came to be lodged.

The learned Additional Public Prosecutor submitted that the petitioner made a complaint on 17.09.2019 to the Director General of Police (DGP), pursuant to which, the DGP instructed the Superintendent of Police to take action on the said complaint made by the petitioner. Thereafter, the matter was forwarded to the respondent, who conducted an enquiry with the petitioner and counter petitioner, and found that the issue involved in the complaint is for the Revenue Authorities, and the same could be decided only by District Revenue Officer (DRO) or the Revenue Divisional Officer (RDO) after conducting an enquiry and submitting a report. Accordingly, the complaint was closed with such advice. At that time, the petitioner allegedly abused the 2nd respondent/The Sub Inspector of Police and obstructed him in the discharge of his duties, and therefore, a case was registered. The investigation has now been completed and the charge sheet has been filed before the trial Court on 30.07.2025. The same was returned, pointing out certain defects, which have been corrected and resubmitted.

4. Heard both sides and perused the materials available on record.

Considering the submissions made by the learned counsel on either side, and also taking into account the fact that the investigation in this case has already been completed and charge sheet filed, this Court is of the view that the contention raised by the petitioner is factual in nature can be denied during Trial. Therefore, this Court is not inclined to entertain the present petition.
