The petitioner, who was arrested and remanded to judicial custody on 08.01.2026, for the alleged offence punishable under Sections 336(2), 337, 336(3), 340(2), 318(4) of BNS Act 2023 (corresponds to Section 465, 468, 471, 420 of IPC) in Cr.No.31 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused fabricated and created Government Order and proceedings such as order of the District Collector, DTCP Approval with plan and proceedings etc. It is further alleged that the petitioner has demanded and received a sum of Rs.80,00,000/- from the defacto complainant, which led to the registration of the case. Hence, the present petition has been filed by the petitioner for seeking bail.
3. The learned counsel for the petitioner has submitted that the petitioner has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is ready to cooperate with the investigation and also ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Puducherry) appearing for the respondent police reiterated the prosecution case and submitted that the investigation in this case is pending. Hence, he vehemently opposed for grant of bail to the petitioner.

Considering the nature, the gravity of the offence, the fact that, it is a case of fabrication of official records and the petitioner along with other accused collected huge amount, also cheated the defacto complainant and so far no money is recovered, that investigation in this case is pending, I am not inclined to grant bail to the petitioner.
8. Accordingly, this Criminal Original Petition is dismissed. 25.02.2026 Vv To
