Mr. Leonard Arul Joseph Selvam Additional Public Prosecutor for Ms.T.Harshana for R1 to R3 Order This Writ Petition has been filed seeking a direction to the 3rd respondent to conduct an enquiry based on the petitioner's complaint dated 03.01.2024, bearing CSR No. 3/2024, issued by the 3rd respondent, and to complete the same within a time frame to be fixed by this Court.

2. Considering the submissions made and upon perusal of the materials available on record, it is seen that the petitioner is the proprietor of K.K. Thangamaligai who has lodged a complaint against the 4th respondent. The 4th respondent, a former employee of the petitioner, is alleged to have misappropriated jewellery and articles belonging to the petitioner, amounting to several lakhs. Though the complaint was lodged, no effective steps have been taken against the 4th respondent. Instead, the petitioner has been repeatedly called under the guise of enquiry and allegedly harassed.

3. The learned Additional Public Prosecutor submitted that, pursuant to the petitioner's complaint, the 4th respondent was called for enquiry. Both the

petitioner and the 4th respondent appeared on 09.03.2026. The petitioner sought time to verify the stock of jewellery and accounts and undertook to revert on the following day. The 4th respondent also agreed to submit his explanation and initially contended that the petitioner was fabricating old bill books and making unnecessary claims. He further stated that he is ready to provide a full explanation.

4. The learned counsel for the petitioner, on instructions, submitted that the petitioner would appear before the respondent on 02.04.2026 along with necessary documents. The respondent police are directed to ensure the presence of the 4th respondent on that day, conduct the enquiry, and proceed further in accordance with law. The respondent police shall not unnecessarily summon or harass either the petitioner or the 4th respondent under the guise of enquiry.
