CR.NO.36 OF 2007 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed by this Hon'ble Court, in Crl.M.P.No.2220/2019 in Crl.A.No.613/2018 on 14.02.2019 directing the petitioner to appear before the Committal Court on the first working day of every week at 10.30 a.m.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. P.SURESH, Advocate for the Petitioner and of M/S.K.PRABAKAR, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by P.N.PRAKASH,J.) This petition has been filed to relax the condition imposed by this Court vide order dated 14.02.2019 passed in Crl.M.P.No.2220 of 2019 in Crl.A.No.613 of 2018, directing the petitioner to appear before the committal Court on the first working day of every week at 10.30 a.m.

This Court, by order dated 14.02.2019 in Crl.M.P.No.2220 of 2019 in Crl.A.No.613 of 2018, granted suspension of sentence and bail to the petitioner on certain conditions, one of which is that the petitioner should appear before the committal Court, on the first working day of every week at 10.30 a.m. until further orders. 3.
On instructions, the learned Additional Public Prosecutor submitted that the petitioner has been complying with the said condition.
In view of the above, this petition is allowed and the aforesaid condition is modified to that effect that, "the petitioner shall appear before the trial Court on the first working day of every month at 10.30 a.m. until the disposal of the appeal and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court". -sd/- 15/04/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
