ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) TN of Scheduled commodities Act (RDCS) order 1982 & 7(1)(a)(ii) Essential Commodities Act, 1955 in Crime No.49 of 2026, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused involved in illegally procuring and transporting 15,000 kgs of rice meant for the public distribution system, and while A2 was transporting the same, the vehicle was intercepted and he was arrested with the rice, and the statement recorded from him revealed that this petitioner is the one who sent the rice and is also a vehicle owner. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and there is no previous case against him. Therefore, he prays for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is ranked

as A1 and the investigation is pending. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. Considering the fact that a huge quantity of rice has been seized and the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
