The petitioner, who apprehends arrest by the respondent police for the alleged offences punishable under Sections 326(a), 303(2) of BNS Act, in Crime No.23 of 2026 registered on the file of the respondent police, seeks anticipatory bail.

2. The allegation against the petitioner is that while he was illegally transporting three bags of river sand weighing about 93 kgs from the Kossasthalaiyar river, on seeing the police patrol party, he fled from the scene of occurrence. Hence a case has been registered against the petitioner.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the quantity involved is huge quantity and that the petitioner has no previous case pending against him. Hence, she opposed to grant anticipatory bail to the petitioner.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent police and perused the materials available on record.
6. Considering the nature of allegations, the quantity involved is a huge quantity, and considering the fact that the petitioner is not only 2/4
illegally quarried river sand but also caused damage to the ecology and river bed, this Court is not inclined to grant anticipatory bail to the petitioner.
