C.M.P.No.5805 of 2022 has been filed by the appellant in A.S.No.943 of 2005 to condone the delay of 2148 days in filing the petition to set aside the abatement caused due to the death of the 6th respondent.

2. C.M.P.No.5807 of 2022 has been filed by the appellant in A.S.No.943 of 2005 to set aside the abatement caused due to the death of the 6th respondent.

3. C.M.P.No.5809 of 2022 has been filed by the appellant in A.S.No.943 of 2005 to bring on record the proposed respondent herein as the legal representatives of the deceased 6th respondent.

4. The learned counsel for the petitioner seeks to dismiss the present petitions as not pressed on the ground that the 6th respondent was a tenant in the suit property at the time of filing the suit for partition and at present, he is not a necessary party. Further, the learned counsel for the petitioner has also made an endorsement to that effect.
