This writ petition is filed for the following relief: "To direct the 1st respondent to consider and pass orders on the petitioner's Appeal dated 07.10.2022, within a time stipulated by this Court."

2. The petitioner was working as a Bill Clerk in the Tamil Nadu Civil Supplies Corporation (TNCSC). The petitioner would submit that a criminal case was registered against him in FIR in Cr.No.180 of 2020 by the CSCID Chennai Unit and subsequently, the petitioner was 2/6

placed under suspension on 22.07.2020, by the 2nd respondent. A Departmental Enquiry was initiated vide Charge Memo in R.C.No.A21/003626/2020 dated 03.09.2020, alleging illegal disposal of 88 bags of rice.

3. The petitioner categorically denied the charges by relying on the Point of Sale (POS) machine records and the Area Officer's inspection report which clearly showed "Nil" stock discrepancy, proving the charges to be factually impossible. The petitioner submits that the Disciplinary Authority passed a final order imposing a punishment of stoppage of increment for 3 months with cumulative effect.

4. Aggrieved by the said order, the petitioner preferred a statutory appeal before the 1st respondent (Appellate Authority) as per the TNCSC Employees Service Regulations, 1989. The appeal was filed as early as on 07.10.2022, however, the 1st respondent has not disposed of the said appeal. Therefore, the petitioner is before this Court seeking a direction to the 1st respondent to dispose of the petitioner's appeal. 3/6

5. Considering the limited relief sought by the petitioner, this writ petition is allowed. The 1st respondent is directed to dispose of the petitioner's appeal, within a period of 2 months from the date of receipt of a copy of this order. No costs.
