O R D E R

The writ petition has been instituted to direct the respondents4 to 6 to provide the EB service connection to the petitioner petrol bunk.

2. With reference to the relief sought for in the present writ petition, the Assistant Engineer provided an information stating that the one service wire was found to be defective and the said defect has been rectified and the electricity service connection has been restored in the Petrol Bunk premises. Since the electricity service connection has already been restored in the Petrol Bunk, no further consideration is required.

3. To rectify the service wire under repair, the Electricity Board authorities have asked Mr.Rathinavelu, who is the father of the writ petitioner has to submit an application. However, the respondents have stated that the electricity service connection is functional in the premises of the Petrol Bunk.

4. The learned Standing Counsel appearing on behalf of the Tamil Nadu Electricity Board submitted the copy of the Extract of the Consumer Ledger, wherein the name of the consumer has been stated as 'K.Rathinavelu'. The status of the Service Connection is 'live'. Relied on the Ledger, the learned Standing Counsel would submit that the Service Connections are 'live' and there is a dispute exists between the writ petitioner and the 7th

respondent, who is none other than the father of the writ petitioner.

5. Such family disputes cannot be resolved by the Tamil Nadu Electricity Board Authorities. If at all the name transfer is to be effected, the procedures are to be followed and the Authorities have to consider strictly by following the due process.

6. However, in the present case, the Service Connection stands in the name of the 7th respondent Mr.K.Rathinavelu and it is for the petitioner to work out his remedy in the manner known to law.

7. With the above observations, the present Writ Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. However, there shall be no order as to costs. 15.04.2024 Jeni Index : Yes Speaking order
