ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.09.2025 for the alleged offence punishable under Sections 331(4), 305 of BNS, in Crime No.263 of 2015, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he entered into the shop of the defacto complainant and committed theft of a sum of Rs,6,65,500/-. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated, on account of previous cases against him. He further submitted that he is in judicial custody since 23.09.2025 and that he is ready to co-operate with the investigation. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is a habitual offender and is involved in 55 previous cases pending against him. He further submitted that, out of Rs.6,65,500/-, a sum of Rs.3,40,000/- has been recovered and the remaining amount is yet to be recovered. Hence, he opposed to grant bail to the petitioner.

5. Considering the nature of the allegations and the fact that the petitioner has bad antecedents and that only a portion of the stolen amount was recovered, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 20.02.2026 drl 2/4
